O ideário nórdico sobre os direitos de um prisioneiro é de fazer um justiceiro brasileiro hiperventilar.
Só recolhendo os cacos de muitas verdades absolutas será possível tentar compreender a atordoante notícia que trazem os jornais noruegueses: Anders Behring Breivik, autor confesso do massacre brutal que chocou o mundo em 2011, vai processar o governo da Noruega. De dentro da prisão.
Breivik diz que seus direitos humanos estão sendo violados na penitenciária. E será ouvido.
Puxemos, antes, a capivara do atirador.
No dia 22 de julho de 2011, o ultradireitista Anders Breivik cometeu um duplo atentado que matou 77 pessoas, em protesto contra o que ele chamou de “invasão muçulmana” do país. Primeiro, detonou uma bomba perto da sede do governo norueguês em Oslo, provocando a morte de oito pessoas. Em seguida, abriu fogo contra uma multidão da Juventude Social-Democrata reunida em um acampamento de verão na ilha de Utoya, próxima à capital, matando 69 pessoas – quase todos adolescentes.
Da sua folha corrida escorre sangue em cascata – mas, em nome do robusto respeito às normas universais que garantem a proteção aos direitos humanos de cada cidadão da Noruega, neste caso isso literalmente não vem ao caso.
Assim como dita a lei para todos os presos na Noruega, a Anders Breivik deve ser dado o direito de ir à Justiça defender seus direitos. As audiências do processo que ele move contra o Estado estão previstas para 15 de março.
Em outras palavras, na Noruega até o carniceiro de Utoya tem direitos.
Preso desde 2012 em regime de isolamento, Breivik cita o Artigo 3 da Convenção Européia de Direitos Humanos para alegar que suas condições de confinamento na penitenciária de segurança máxima de Skien constituem tortura.
Alega ele também que a pré-censura das cartas que envia e recebe na prisão viola o Artigo 8, que trata do direito de um indivíduo a “vida privada e em família, sua casa e sua correspondência”.
Alega ainda seu advogado, Øystein Storrvik, que ao ser privado de um contato mais frequente com outras pessoas Breivik está efetivamente sendo impedido de encontrar uma parceira, em violação ao Artigo 12 da Convenção Européia – o direito de se casar.

Anders descreve a prisão como “um inferno”. Em 2014, chegou a ameaçar entrar em greve de fome na prisão para exigir a troca de sua Playstation 2 por uma Playstation 3, além de demandar um sofá ou uma cadeira mais confortável na cela.
“Outros detentos têm acesso a videogames melhores, enquanto eu só tenho direito a jogos infantis e menos interessantes, como por exemplo o ‘Rayman Revolution’”, escreveu o atirador em uma carta.
No ano passado, sua disposição de processar o governo ganhou fôlego após uma visita à prisão feita pelo Ombudsman Civil, que é o responsável pela investigação de possíveis injustiças cometidas por autoridades públicas na Noruega.
“O regime de isolamento em unidades de segurança máxima impõe condições extremamente rígidas para a liberdade de movimento dos detentos, e sua possibilidade de manter contato com outras pessoas”, constatou em seu relatório o Ombudsman, Aage Thor Falkanger.
“Isto, e o fato de que há um número muito limitado de detentos em uma unidade de segurança máxima, significa que tal regime de prisão representa um elevado risco de constituir tratamento desumano’”, completou Falkanger.
Mais: este ano, Anders Breivik começou a estudar Ciências Políticas na Universidade de Oslo, a partir de sua cela. No website da universidade, o reitor admitiu ter enfrentado “dilemas morais” para aceitar a inscrição do atirador, apesar de Breivik ter obtido todas as qualificações para tal. Mas concluiu: “A universidade deve manter o respeito às suas regras – pelo bem de nós mesmos como sociedade, e não dele (Breivik)”.
Em respeito ao dinheiro do contribuinte, foi decidido que as audiências do processo movido por Breivik serão realizadas na própria prisão de Skien (sudeste da Noruega), onde o atirador está encarcerado. Quer-se, assim, economizar os gastos com transporte e segurança.
Ainda não se sabe se Breivik conseguirá convencer a Justiça de que o inferno são os outros.
Serão os nórdicos loucos, ou visionários?
Certa vez, ao visitar a maior penitenciária de segurança máxima da Suécia, observei que as instalações eram comparáveis às de um hotel cinco estrelas, onde os presos tinham ainda acesso a bibliotecas, cursos universitários e treinamento profissionalizante de qualidade.
O diretor da prisão me disse então o seguinte: “Para a Suécia, a perda da liberdade já é o maior castigo que se pode impor a um indivíduo. Daqui de dentro, devem sair pessoas melhores e mais capacitadas”.
Provavelmente a regra não se aplica ao caso de Breivik – sua pena, de 21 anos de prisão, poderá ser prorrogada caso ele ainda seja considerado um perigo para a sociedade.
Mas o direito nórdico mostra que pau que não bate em Chico, também não bate em Francisco.

E o direito das vitimas no caso um pai de familia assassinado
Segundo eles, defensores do sistema, a vítima que se dane, já está morta mesmo, apodrecendo, não reclama mais e não sairá depois de cumprir 1/3 ou 1/6 da eternidade. No caso de estupro sem morte, segundo os ”humanistas do frio”, a vítima deveria se sentir grata pela experiência atípica, mudando sua rotina entediante, o algoz, afinal, lhe fez um favor, ainda mais se ele foi o primeiro (ligar sarcasmo, pls)
Entendo o caso de uma sociedade mais justa buscar ser mais humana com criminosos, MAS a exceção deve sempre aparecer em casos de exceção. O carniceiro de Utoya é um psicopata, cometeu um crime abominável e tinha mesmo é que ser isolado do mundo.
Claudia Wallin, isso é de matar os fascistas brasileiros que dizem em alto e bom som, ” Bandido bom, é bandido morto”. O pior, se dizem homens de bem, temente a Deus, chega a ser patético e extremamente contraditório. Eles são contra o aborto e a favor da pena de morte.

Diga isso quando matarem vc ou alguém da sua família. Seria uma experiência extremamente pedagógica. Que ela não demore! Tenho certeza que vai adorar aprender sofre aflição, sofrimento e vingança. A vítima é a razão de ser da Justiça, não os algozes.
Se me matarem, possivelmente não vou dizer nada… mas continuo dizendo o que disse mesmo após ter sido assaltado por duas vezes e meu pai ter sido feito refém por 04 horas na mira de duas pessoas armadas… sofri… foram experiencias que não desejo a ninguém. Meu comentário foi no sentido de termos um direito penal justo, racional, e não meramente fundado em vingança. Fique em paz.

É que os presos de lá têm curso superior
Aqui a maioria dos trabalhadores, honestos, não tem este “conforto”, seria o cúmulo da injustiça que criminosos condenados tivessem.
O cumulo é a população brasileira abonada na hora de votar e exercer a cidadania não levar a serio seu papel na cobrança de que os honestos e trabalhadores possam ter acesso a esse “conforto”. Muito pelo contrário, se puderem explorar a mão de obra…o fazem como se nada estivesse acontecendo.
O cumulo é a falta de humanidade com que o trabalhador é tratado e constantemente tem de brigar por direitos trabalhistas.
O cumulo é um homem que defende a diminuição dos salários de mulheres trabalhadoras ser chamado de mito. Viabilizar dignidade ao ser humano nitidamente não é valor para muito brasileiro.

As prisões brasileiras são a ” cara” da corrupção institucionalizada em todos os níveis da sociedade ( desde os governantes até o agente de segurança ou o responsável pela comida dos presos) que não preza por seus cidadãos ( que pagam impostos absurdos ) e sim por seus interesses particulares e por um projeto de poder criminoso … Não temos segurança pública , sistema prisional decente e justo ( que inclusive ponha o preso pra trabalhar e produzir ) …Todo os nossos impostos recolhidos, que deveriam voltar à sociedade sob a forma de saúde pública digna , educação e acesso à cultura imparcial ( que reduziria bastante o volume de potenciais encarcerados ) , empregos ( estímulo ao empreendedorismo ) , moradia acessível e segura , segurança pública , alimentam a ganância e psicopatia governamental dessa Nação … Tudo é desviado , valores materiais e morais!!! Chega disso !!! Há presos irrecuperáveis por conta das falhas da Justiça que estimulam a recorrência no crime e na marginalidade e aumento da ousadia e truculência dos bandidos ! Aqui a lição é : ” o crime compensa ” !

Tratar um carniceiro como humano é um desrespeito aos humanos. Eu penso o contrário. Um sujeito que comete uma barbárie dessa não merecia sequer estar preso, mas, sim, ser jogado ao mar a milhares de quilômetros do litoral e em um local onde há grande quantidade de tubarões branco.
Infelizmente, o cidadão comum brasileiro não dispõe dessa qualidade de vida.
Pois é… E aí vem esta senhora mostrar a “prisão” dos países nórdicos… Vamos colocar nossos presos para viver assim… Alguns brasileiros nem banheiro tem… Esta Claudia Wallin é meio utópica…
Janete Vieira não é utópica, é que ela ainda não sentiu na pela como é bom enfrentar um estuprador, nem ter de enterrar alguém que ama morto pelas mãos de assassinos, incluindo os que matam usando carros. Quando não se sente na pele, no dos outros é refresco. E se passar pelos fatos que citei e ainda fingir a ”nobreza” de tanta consideração pelo algoz, então não amava quem enterrou, é indigna de viver. Uma pena não haver um meio de a vítima saber que tipo de sentimento perpassa quem deveria justiçá-la, bem que trocaria de lugar sem pensar duas vezes. Por isso não tenho esse deslumbre todo por Europa de ”primeiro” mundo, sobretudo a dita ‘Escandinávia’, em termos de lei e Justiça sou mais o modelo japonês. Sempre estiveram na frente da Europa em termos de civilização.
A cultura brasileira prega a vingança e não a justiça!
Não é a Justiça, são as vítimas e familiares que pedem e estão certos. Pena a violência não ter ainda chegado até gente assim como você, só aprendem a dor quando são alcançadas por ela. Mostre aí quantos menores como Champinha estão na sua casa tendo uma oportunidade? Senti falta dele nas suas festinhas de família, dividindo o mesmo quarto de tantas gente bonita… No Fb é fácil ser moderno e humano com bandidos, já em casa são outros 500. Quem não pensa nas vítimas e na dor de seus familiares não merece viver, nem no Brasil, nem em lugar nenhum.
Ai meus amigos, 99% da população Brasileira optaria por ser preso. Teria melhor vida preso que solto, como está hoje em dia.

Devido a quantidade de pessoas que este desgraçado matou, queria mais que ele estivesse preso dentro de uma pocilga, concordo com o sistema dos nórdicos, mas ficar com mimi mi com um sanguinário , que jamais deve ser solto, pois vai cometer tudo outra vez!!!

Lembrando que não tem como comparar o nível de intelectualidade e trato social dos nórdicos com os brasileiros.

Todo mundo acha lindo defender o direito dos bandidos, mas somente até o dia em que são vítimas de algum marginal. Como sempre mostram apenas metade da verdade. O atirador em questão é sueco e a Suécia abriu tanto as portas para a criminalidade q hoje é a capital mundial dos estupros!
E as vítimas são induzidas, na Suécia, a não revelarem que seus estupradores são ”aqueles”. A ”linda sociedade sueca” já está instituindo o estupro com ou sem morte como fato normal. Não invejo nem um pouco nem quem mora lá, menos ainda quem tem as ideias desumanas que e eles alimentam contra vítimas. São doentes! Com igualdade de ganhos, mas doentes, podres por dentro! A questão prisional dever ser tratada com equilíbrio, ciente de que o objetivo é PUNIR e RECUPERAR. Condenados não devem ser tratados desumanamente, mas também não devem ser tratados como cidadãos íntegros; ou seja, criminosos devem, sim, perder certos direitos, para que não se gere na sociedade um sentimento de impunidade. Enfim, nem o rigor de Jair Bolsonaro, nem a complacência de Maria do Rosário.
Obs.: apesar de alguns exageros, Bolsonaro tem mais moral de que todos os ‘esquerdopatas vitimistas’ juntos!

Quanto às acomodações,confere com essas informações mas,do ponto de vista do que os tribunas suecos estão permitindo que façam com essa mãe brasileira de um menino autista…Apenas porque o pai biológico de Lucas é funcionário de um ministro Sueco,o processo contra essa brasileira contém atrocidades que levam um a duvidar tratar-se da Suécia.Essa mãe foi atirada nessa armadilha pela coordenação da ACAF brasileira e desde então,meu Deus! tem sido bizzarro! Suécia vive fechando presídios por falta de condenados e usando esses recursos pra investir mais em educação. Enquanto que nós, fechamos escolas para podermos abrir mais presídios.

Não existe um sistema perfeito, ter o chefe do chefe, não resolve, é uma questão cultural, não se respeita determinados valores, a menos que alguém esteja olhando, se ninguém estiver olhando, então substrai-se o que não lhe pertence, aproveita-se de vantagens que não tem e assim por diante. Isso só vai se resolver quando a enorme maioria da população estiver convencida de duas coisas, 1- não fazer, 2 – não deixar fazer.
