E destacou que a proposta de mudança na aposentadoria dos brasileiros é a reforma prioritária de seu governo:
“Sabemos todos que o assunto é sensível – mas é inadiável. Hoje, as contas da Previdência simplesmente não fecham”.
Já no mundo paralelo do Olimpo congressual, as regras são aprazíveis: reportagem do Congresso em Foco mostra que deputados se aposentam com apenas dois anos de mandato – e mais: que um deputado pode se aposentar a partir de apenas um ano de exercício do cargo, desde que faça averbações (aproveitamentos) de outros mandatos ou contribuições ao INSS.
As contribuições ao INSS contam para o tempo de contribuição – é necessário um mínimo de 35 anos –, mas não são consideradas para o cálculo do valor da aposentadoria.
E os arquivos da Câmara registram casos de deputados que se aposentaram mesmo sem terem feito contribuições previdenciárias.

Deputado se aposenta depois de apenas dois anos de mandato
O deputado Manuel Rosa Neca (PR-RJ) chegou à Câmara como suplente, em janeiro de 2013. Cinco meses mais tarde, ingressou no plano de previdência dos congressistas. Completou apenas dois anos de mandato como deputado federal. Com o aproveitamento (averbação) de parte de mandatos anteriores de vereador e prefeito em Nilópoles (RJ), além de mais 26 anos de contribuição ao INSS, conseguiu a aposentadoria e recebe, hoje, R$ 8,6 mil. Esse é um dos exemplos das facilidades do Plano de Seguridade Social dos Congressistas (PSSC), que conta com regras bem mais brandas e flexíveis do que as previstas na reforma da Previdência a ser votada pelos deputados e senadores nos próximos meses.
Mas as regras do plano são ainda mais permissivas. Um deputado pode se aposentar a partir de apenas um ano de exercício do cargo, desde que faça averbações de outros mandatos ou contribuições ao INSS. O ex-deputado Junji Abe (PSD-SP) exerceu o cargo por apenas quatro anos, entre 2011 e 2015. Em janeiro de 2015, teve aprovadas pela Câmara a averbação de mandatos de deputado estadual, vereador e prefeito de Mogi das Cruzes que somavam 20 anos de exercício desses cargos. O valor da averbação ficou em R$ 1,4 milhão. Em junho daquele ano, conseguiu ainda o aproveitamento de 12 anos de contribuições ao INSS. Fechou 24 anos de mandatos e assegurou uma aposentadoria de R$ R$ 23 mil.
Com três mandatos, entre 2003 e 2015, o deputado Carlos Souza buscou 24 anos de contribuições ao Governo do Amazonas, ao INSS e utilizou até mesmo o período de prestação de serviço militar ao Exército, de 1971 a 1972. Recebe R$ 10,6 mil como aposentado. O ex-deputado Ronaldo Zulke (PT-RS), que exerceu o mandato de 2011 a 2015, teve aprovada a averbação de 34 anos de contribuições e aposentou-se em fevereiro de 2015. Recebe R$ 3,8 mil.
As contribuições ao INSS contam para o tempo de contribuição – é necessário um mínimo de 35 anos –, mas não são consideradas para o cálculo do valor da aposentadoria. As averbações de mandato são pagas – cerca de R$ 7,4 mil por mês recuperado – e entram no cálculo da aposentadoria. Mas nem sempre é assim.
Também com três mandatos, o deputado Gervásio Silva (PSDB-SC) teve reconhecidos 23 anos de contribuição ao RGPS (Regime Geral de
Previdência Social), mais cinco anos pelo mandato de vereador e quatro pelo mandato de prefeito em São José (SC). A averbação foi “não onerosa”, o que significa que o parlamentar não pagou a contribuição mensal para cada mês acrescentado ao seu tempo de contribuição. Os arquivos da Câmara registram que “não houve contribuição previdenciária”, mas destaca que o tempo de serviço registrado foi exercido antes da Emenda à Constituição nº 20/1998, podendo assim ser contado como tempo de contribuição para efeito de aposentadoria. Silva conseguiu a aposentadoria e recebe, atualmente, R$ 11,5 mil.
Durante o mandato, o deputado segurado paga R$ 3,7 mil por mês ao PSSC – parcela igual àquela paga pela Câmara. Isso representa 11% do salário do parlamentar, que está em R$ 33,7 mil. Se comprovar os 35 anos de exercício de mandatos – federais, estaduais ou municipais – e 60 anos de idade, recebe aposentadoria integral, no mesmo valor do salário de deputado. Em 2015, 24 deputados se aposentaram, com aposentadoria no valor médio de R$ 18,4 mil. Nem todo o período de averbação aprovado é aproveitado. Quando sobra tempo de contribuição, ou falta dinheiro ao deputado, acontece a “desaverbação” parcial ou total. Mais uma regra bastante flexível.
O deputado Fernando Ferro (PT-PE) chegou a 20 anos de mandato parlamentar e teve reconhecidos 15 anos de contribuições ao INSS. Mas
precisou averbar quatro anos relativos ao antigo Instituto de Previdência dos Congressistas (IPC), entre 1995 e 1998. Ele não precisou recolher a cota patronal, que já havia sido paga pela Câmara à época do referido mandato. A operação custou R$ 126 mil. Mas cada mandato acrescido representa um acréscimo de R$ 3,8 mil na aposentadoria. O investimento será recuperado em menos de três anos. Recebe hoje R$ 21,2 mil como aposentado.
“Um absurdo”
Mesmo internamente há quem critique as facilidades oferecidas pelo PSSC. Informado sobre a aposentadoria de um colega após dois anos de mandato, o deputado Décio Lima (PT-SC), foi direto: “Isso é um absurdo. Tem deputado que entra aqui como suplente, averba um monte de tempo e sai daqui aposentado. Eu acho que isso tudo devia acabar. Deveria ter um regime geral. A lei abre uma porteira que não deveria abrir”, protestou o deputado, em entrevista ao Congresso em Foco.
Questionado sobre o valor da aposentadoria desse deputado (R$ 8,6 mil), responde: “Não é pouco não, é muito. É um modelo de privilégio capitalista”.
Mas, enquanto o plano não acaba, Lima está buscando as suas averbações: quatro anos do mandato de vereador e oito pelo de prefeito de Blumenau. Os anais da Câmara registram que ele terá que pagar R$ 1 milhão ao plano de previdência. “Eu aderi a esse instituto há dois anos convencido por várias razões. Primeiro, tive que abandonar a advocacia por 20 anos. Não tenho mais como voltar no mercado. Não tenho tempo para me aposentar no Regime Geral. Eu não tive alternativa. Estou me desfazendo de patrimônio, de tudo, para me prevenir, porque têm muitos ex-deputados brasileiros sem renda, pessoas que largaram tudo pela paixão da política e ficaram sem renda”, justificou.
Reforma
Os reflexos da reforma da Previdência no plano dos congressistas ainda não estão claros para alguns dos segurados. O deputado Vilson Covatti (PP-ES), que já deixou o mandato, mas ainda busca averbações para assegurar a aposentadoria, afirma que a reforma é necessária: “Tudo tem que ser ajustado”. Questionado se vai mexer com o PSSC, responde, confuso: “Não, é um plano que não é privado, mas é basicamente privado. Não sei se interfere”.
Décio Lima diz que a reforma da Previdência “faz parte da proposta de subdesenvolvimento desse governo que caracterizamos como golpista. Ela é totalmente desnecessária, é tirar dos pobres para resolver o problema do capitalismo. E nós vamos resistir para impedir qualquer alteração que signifique retiradas de direito do povo”. Sobre os reflexos no plano dos congressistas, afirma, convicto, ou quase: “Mexe, atinge todos. Eu ainda não li o texto, mas acho que atinge todos”.
Um milênio
A decisão do governo de fazer a reforma da Previdência – e com normas bastante duras, como os 49 anos de contribuição – levou os deputados a buscar averbações para completar o tempo de contribuição e assegurar uma aposentadoria mais robusta. Como mostra levantamento feito pelo Congresso em Foco, as averbações feitas
por 69 deputados em 2015 e 2016 somaram 960 anos – quase um milênio. No mesmo período, 150 deputados aderiram ao PSSC. O novo plano foi criado para substituir o Instituto de Previdência dos Congressistas (IPC), que tinha normas ainda mais benevolentes, como a aposentadoria após oito anos de contribuição, sem necessidade de averbação de outros mandatos.
O novo plano estabeleceu idade mínima de 60 anos – antes era 50 anos – e 35 anos de contribuição. Mas, ao longo dos anos, os parlamentares
foram abrindo brechas na lei que descaracterizaram o PSSC. Uma delas é a reabertura do prazo para filiação – o que já ocorreu quatro vezes, em 2005, 2006, 2010 e 2014. Após a edição do Ato da Mesa 148/2014, por exemplo, dezenas de deputados pediram a inclusão no plano com o aproveitamento dos últimos cinco anos para contagem de tempo de exercício de mandato, após recolhidas as contribuições do período.
Após um ano
Questionada sobre a aposentadoria de um deputado após dois anos de mandato, a Câmara respondeu que o deputado pode se aposentar pelo PSSC “a partir do primeiro ano de mandato”, na proporção de 1/35 por ano inteiro de mandato/contribuição, desde que tenha 35 anos de contribuições previdenciárias e 60 anos de idade.
Sobre as averbações, informou que o parlamentar também pode averbar tempo de mandato eletivo federal, estadual e municipal, desde que pague
retroativamente a contribuição ao plano, conforme está previsto no artigo 5º da Lei 9.506/97. Esclarece ainda que as contribuições ao INSS servirão para contagem de tempo de
contribuição, mas não para cálculo do valor da aposentadoria pelo PSSC. O deputado deve optar pela aposentadoria do PSSC, na proporção dos
anos de mandato, ou pelo INSS. Não pode ser acumulado.
A Câmara confirma que está mantida a reaposentadoria: “Se o deputado aposentado voltar a exercer o mandato e optar por contribuir para o PSSC, nesse período, poderá averbar esse tempo para atualizar os valores. Lembrando que o exercício de mandato suspende o benefício da aposentadoria que o deputado estiver recebendo”.
A respeito da natureza jurídica do plano, informa: “O PSSC é um regime próprio de previdência de parlamentares, administrado pela União, por meio de cada uma das Casas do Congresso Nacional, nos moldes do regime próprio dos servidores públicos. Não é uma entidade fechada de previdência e sim um regime orçamentário na modalidade benefício definido e financiado por repartição simples”.
