As recentes notícias da Corte brasileira, data venia, desafiam soberbamente o limite da indignação do cidadão diante de atos estrambólicos de auto-ajuda praticados pelos guardiões da Justiça.
A nível federal, o Conselho Nacional de Justiça autorizou o pagamento de auxílio-moradia a todos os juízes do país – incluindo aqueles que trabalham em suas cidades de origem, e têm residência própria.
O valor do benefício: até R$ 4.377,73 mensais, mesma quantia à disposição de ministros do Supremo Tribunal Federal. O impacto nos cofres do Estado: R$ 840 milhões por ano, segundo cálculos da Advocacia Geral da União (AGU).
Ato contínuo, o Conselho Nacional do Ministério Público aprovou o mesmo benefício para todos os procuradores do país.
No Rio de Janeiro, em proposta particularmente indecorosa, o Tribunal de Justiça encaminhou à Assembléia Legislativa um projeto para conceder bolsa-escola de até R$ 7.250 mensais para financiar a educação dos filhos de magistrados e servidores – desde os oito anos até os 24 anos de idade.
Diante dos protestos gerados, o teto do benefício deve ser reduzido para R$ 3.030 mensais, valor ainda estupidamente mais alto do que – por exemplo – o salário médio dos professores.
A presidente do Tribunal de Justiça do Rio, Leila Mariano, argumenta que os magistrados reivindicam o mesmo auxílio-educação já concedido pela Assembléia, este ano, aos integrantes do Ministério Público estadual. Na singela lógica de Leila Mariano, o benefício seria também uma extensão aparentemente natural do auxílio-creche que há tempos já se paga, com dinheiro público, aos magistrados (1.010 mensais) e servidores (850 mensais) do tribunal: assistência do berço à universidade.
Mais sentido haveria em se conceder um auxílio-figado aos contribuintes, que, além de pagar a conta dos caudalosos privilégios políticos, ainda bancam a fatura dos benefícios e mordomias oferecidos aos representantes do poder que têm a responsabilidade de proteger os direitos do cidadão.
Viagens de avião pagas a ministros do STF, com dinheiro público, mesmo quando eles estão de férias. Carros oficiais com motorista para juízes, desembargadores, e também procuradores e promotores. Banheiras de hidromassagem instaladas em apartamentos funcionais da Corte suprema. À elite da magistratura, tudo: auxílio-alimentação, auxílio-saúde, auxílio-transporte, auxílio-pré-escolar, auxílio-moradia, abono de permanência, gratificação de Natal e mais uma sequência de gratificações extras, a exemplo do adicional de insalubridade e da indenização de férias (que aliás, para juízes, são de 60 dias anuais). Extravagâncias que se reproduzem em efeito cascata pelas diferentes instâncias do Judiciário e do Ministério Público, à medida em que uma categoria corre atrás de benefícios que a outra já conquistou a fim de driblar o teto constitucional e assim esticar os vencimentos.
Mais prudente, no entanto, seria resgatar a fundamental noção da importância do respeito público de uma sociedade por seu Poder Judiciário.
Qualquer democracia consequente sabe dos perigos que o descrédito da justiça acarreta – e por isso os evita.
Tome-se, por exemplo, a Suécia.
Em nenhuma instância do Judiciário sueco, magistrados têm direito a carro oficial e motorista pago com o dinheiro do contribuinte. Sem auxílio-aluguel e nem apartamento funcional, todos pagam do próprio bolso por seus custos de moradia.
Para viver em um país que tem um dos mais altos impostos do mundo, e um dos custos de vida mais elevados do planeta, os juízes suecos têm salários que variam entre 50 e 100 mil coroas suecas – o equivalente a cerca de R$ 16,5 mil e R$ 33 mil, respectivamente.
Para ficar no exemplo dos vencimentos máximos de um magistrado sueco: descontados os impostos, um juiz da Suprema Corte da Suécia, que tem um salário de 100 mil coroas, recebe em valores líquidos o equivalente a cerca de R$ 18,2 mil por mês.
No Brasil, um juiz federal recebe salário de 25,2 mil, e os ministros do STF – que ganham atualmente 29,4 mil – aprovaram proposta para aumentar os próprios salários para 35,9 mil. Isso sem contabilizar os diferentes benefícios e gratificações extras disponíveis para as diferentes categorias do Judiciário: no tribunal do Rio de Janeiro – por exemplo-, entre proventos e benefícios, há juízes recebendo 150 mil mensais.
Na Suécia, não se oferece qualquer tipo de benefício extra a magistrados. Auxílios de todo tipo, abonos, prêmios e verbas de representação não existem para juízes suecos. Nenhum magistrado tem direito a plano de saúde privado. E todos sabem que um juiz, por dever moral, não aceita presentes ou convites para viagens, jantares e passeios de jatinho.
Também não há Excelências entre os magistrados suecos. Assim me lembra Göran Lambertz, juiz do Supremo Tribunal da Suécia, quando pergunto a ele sobre suas impressões acerca dos recentes benefícios reivindicados pela Corte brasileira.
”Claudia, mais uma vez peço a você que me chame de Göran. Estamos na Suécia”, ele diz, quando o chamo mais uma vez de ”Sr. Lambertz”. E prossegue:
”É realmente inacreditável saber que juízes se empenham na busca de tais privilégios. Nós, juízes, somos pagos com o dinheiro dos impostos do contribuinte, e temos que ser responsáveis. Juízes devem ser elementos exemplares em uma sociedade, porque é deles que depende a ordem em um país. E é particularmente importante que não sejam gananciosos.”
Na concepção do sueco, buscar benefícios como auxílio-moradia é uma atitude ”terrível e perigosa”, pois faz com que o cidadão perca o respeito por seus juízes. Com graves consequências para toda a sociedade:
”O Judiciário de um país deve ter o respeito inabalável dos cidadãos”, alerta Lambertz. ”Porque uma das consequências da perda de respeito do cidadão pelos juízes, é que as pessoas também acabam perdendo o respeito pela lei.”
Göran Lambertz faz o que diz: todos os dias, pega a bicicleta e pedala até a estação ferroviária da cidade de Uppsala, a cerca de 70 quilômetros da capital. De lá, toma o trem para o trabalho na Suprema Corte sueca.
A casa do juiz, que já tive a oportunidade de conhecer, é confortável, mas surpreendentemente modesta. Na ocasião, enquanto Göran fazia o café na cozinha, perguntei se ele tinha direito a benefícios como auxílio-alimentação. A resposta foi cortante:
”Não almoço às custas do dinheiro do contribuinte”.
De lá, seguimos – ele de bicicleta e trem, eu de carro – para seu pequeno gabinete na Suprema Corte da Suécia. Não há secretária na porta, nem assistentes particulares. Os 16 integrantes da Corte dividem entre si uma equipe de cerca de 30 assistentes jurídicos, e 13 auxiliares administrativos.
”Luxo pago com o dinheiro do contribuinte é imoral e antiético”, me disse na época o magistrado sueco, em reportagem que foi exibida na TV Bandeirantes.
Leio agora, na imprensa brasileira, que um magistrado rejeitou o recebimento do recém-aprovado auxílio-moradia. O juiz Celso Fernando Karsburg, de Santa Cruz do Sul (RS), abriu mão do benefício por considerá-lo ”imoral, indecente e antiético”.
Um exemplo bem-vindo da moral de Lambertz.
