”Se uma pessoa tem que lutar diariamente por sua sobrevivência, para ter acesso a alimentação, escolas e hospitais, a questão do combate à corrupção na sociedade certamente não estará entre seus principais interesses. Mas quando uma pessoa se sente parte da sociedade à qual pertence, passa a não aceitar os abusos do poder” – Gunnar Stetler
Gunnar Stetler franze a testa, pisca duas vezes e contrai os músculos do rosto, como quem faz um cálculo extraordinário. Percorre os labirintos da memória durante uma longa pausa, e encontra enfim a resposta: nos últimos 30 anos, ele diz, foram registrados apenas dois casos de corrupção entre parlamentares e integrantes do Governo na Suécia.
”Tenho apenas uma vaga lembrança”, diz Stetler. ”É muito raro ver deputados ou membros do Governo envolvidos em corrupção por aqui.”
Estamos no escritório abarrotado de arquivos e papéis do promotor-chefe da Agência Nacional Anti-Corrupção (Riksenheten mot Korruption), no bairro de Kungsholmen. A poucos passos dali, na mesma rua Hantverkargartan, fica a sede da temida Ekobrottsmyndigheten, a Autoridade Sueca para Crimes Financeiros. Com o sol de abril que enfim derreteu o gelo de mais um inverno, do outro lado da rua mães passeiam com seus carrinhos de bebê entre os túmulos do jardim da igreja Kungsholmskyrka, um hábito comum que se estende a vários cemitérios-parque da cidade.
Da sua pequena sala, Gunnar Stetler chefia o trabalho de promotores especializados que investigam os principais casos de suspeita de corrupção no país. Casos menos graves são processados a nível regional, nas diversas promotorias distritais que compõem o cerco sueco contra trapaças, tramóias e falcatruas em geral.
Com 1,93m de altura, expressão grave e ar insubornável, Gunnar Stetler é descrito na mídia sueca como o maior caçador de corruptos do país. Entre os casos sob a sua mira em 2013 estava a denúncia de que a operadora de telefonia sueca TeliaSonera teria pago suborno no valor de 337 milhões de dólares para estabelecer operações no Uzbequistão.
”Historicamente, 75 por cento das acusações formais contra crimes de suborno na Suécia terminam em condenações”, diz Stetler.
Nascido em 1949, Stetler ganhou fama após conduzir casos como o de um ex-diretor da empresa sueca ABB, condenado a três anos de prisão em 2005 por ter desviado 1,8 milhão de coroas suecas para uma empresa registrada no paraíso fiscal das Ilhas Virgens Britânicas.
”Chega um momento em que uma pessoa não se contenta mais com um Volvo V70, e quer trocá-lo por um Porsche. A ganância é parte do dilema humano”, reflete Stetler.
Para o promotor-chefe, são três os fatores que mantêm a Suécia à margem das listas de países gravemente corruptos: a transparência dos atos do poder, o alto grau de instrução da população e a igualdade social.
 
. O que faz da Suécia um dos países menos corruptos do mundo?
GUNNAR STETLER: Em primeiro lugar, a lei de acesso público aos documentos oficiais. Esta lei, criada na Suécia há mais de duzentos anos, evita os abusos do poder. Se os cidadãos ou a mídia quiserem, podem verificar meu salário, meus gastos e as despesas de minhas viagens a trabalho. Meus arquivos são abertos ao público. E acreditamos que, ao colocar os documentos e registros oficiais das autoridades ao alcance do público, evitamos que os indivíduos que exercem posições de poder pratiquem atos impróprios. Esta é a razão principal. Em segundo lugar, é preciso citar a lei aprovada na Suécia há cerca de 200 anos [em 1842, nota do autor], que introduziu o ensino compulsório no país e aumentou o nível geral de educação da população.
 
. Qual é o impacto de uma população com maior grau de instrução na prevenção da corrupção?
GUNNAR STETLER: Se uma pessoa não tem acesso à educação, ela não tem condições nem de compreender e muito menos de fiscalizar o sistema. Na Suécia, acreditamos que uma sociedade se constrói não a partir do topo, mas a partir da base da população. Portanto, é preciso oferecer uma boa educação a todas as camadas da sociedade. A China tem um alto grau de corrupção, mas vem investindo na melhoria do nível de instrução da população. Creio que isto irá, de certa forma, reduzir a corrupção no país.
 
. Com que frequência o seu telefone toca com denúncias de corrupção?
GUNNAR STETLER: Recebo cerca de quatro ligações do público todos os dias. Mas de cada 15 denúncias, em geral apenas uma tem base para caracterizar um caso. A maior parte dos casos se refere a questões de menor dimensão, como quando um funcionário público aceita viajar para um resort a convite de uma empreiteira a fim de facilitar um contrato. Se você é um funcionário público na Suécia, não está absolutamente autorizado a aceitar este tipo de convite. Lidamos também com casos de maior envergadura. Acabo de acusar formalmente um dos chefes do Kriminalvården (sistema prisional sueco), que recebeu subornos da ordem de milhões de coroas suecas de uma empresa contratada para construir penitenciárias. Trabalhamos com denúncias do público, da mídia e também de sistemas nacionais de auditoria, como o Riksrevisionen (órgão independente que controla as finanças das autoridades públicas na Suécia).
. Qual é o nível de incidência de casos de corrupção política a nível nacional na Suécia, entre parlamentares e membros do Governo?
GUNNAR STETLER: É muito raro ver deputados ou membros do Governo envolvidos em corrupção por aqui.
 
. Qual foi a última vez que isso ocorreu na Suécia?
GUNNAR STETLER: Se me lembro bem (pausa)…talvez tenham sido uns dois casos (pausa)…nos últimos (pausa)…trinta anos.
. O senhor quer dizer que desde a década de 70 só houve dois casos de corrupção política a nível nacional?
GUNNAR STETLER: Sim.
 
. Que casos foram esses?
GUNNAR STETLER: Se não me engano (pausa)…há cerca de dez anos (pausa)…um deputado do Parlamento, representante da costa oeste, cometeu um erro (pausa)…tenho apenas uma vaga lembrança…
 
Se o senhor tem apenas uma vaga lembrança sobre o que seriam os dois únicos casos de corrupção política a nível nacional nos últimos 30 anos, pode-se presumir que não tenham sido grandes escândalos?
GUNNAR STETLER: Sim. Em termos de corrupção política, casos mais sérios ocorrem principalmente nas municipalidades.
 
. Mas a última vez que um político sueco foi condenado à prisão por corrupção foi aparentemente em 1995. Isso significa que o grau de corrupção política na Suécia não é em geral grave o suficiente para exigir pena de prisão, ou é um sinal de que o sistema é leniente com políticos corruptos?
GUNNAR STETLER: Na Suécia, em geral, toda punição é leniente.
 
. Como assim?
GUNNAR STETLER: No sistema penal sueco, o princípio básico não é a punição, e sim a reintegração do indivíduo à sociedade. Esta é a nossa tradição. O código penal não prevê punição especialmente dura para casos de corrupção política.
 
. Punições mais severas não são então a resposta para combater a corrupção política?
GUNNAR STETLER: Quem pune políticos corruptos é a opinião pública. Se um deputado ou um funcionário da administração estatal pratica um ato de corrupção, ele será punido severamente pela sociedade, principalmente por ter cometido um erro a partir de uma posição de poder. Um deputado, por exemplo, pode ser forçado a renunciar através da pressão da opinião pública e da mídia, mesmo quando não é indiciado formalmente.
 
. Há alguma regra especial para investigar e processar políticos por crimes de corrupção, como a necessidade de obter aprovação do Parlamento ou de algum comitê?
GUNNAR STETLER: Não.
 
. Cabe principalmente à mídia e aos cidadãos fiscalizar o poder, ou a instituições como a que o senhor dirige?
GUNNAR STETLER: Cabe, em primeiro lugar, à imprensa livre. Se a mídia tem acesso aos documentos oficiais, ela poderá agir, juntamente com os cidadãos, para garantir uma sociedade mais limpa. É claro que agentes oficiais, como a Agência Anti-Corrupção, também cumprem um papel importante. Presumo que talvez, no Brasil, os cidadãos não confiem em servidores públicos como eu. Mas na Suécia a maior parte das pessoas confia nas agências do poder público, e uma das razões disso é o fato de que os cidadãos podem supervisionar o que as agências fazem.
. Como é o trabalho da Agência Nacional Anti-Corrupção?
GUNNAR STETLER: Nosso foco principal é o suborno. Pode-se dizer que o suborno, tanto na esfera pública como no setor privado, é um câncer para qualquer sistema. Mesmo quando o valor do suborno é muito baixo, ele pode influenciar uma licitação no valor de um bilhão de coroas suecas. No setor público, é importante que as compras de bens e serviços sejam realizadas de modo correto. A construção de um novo hospital, por exemplo, pode custar cerca de 1,7 bilhão de coroas suecas (cerca de 260 milhões de dólares). Quando uma agência do setor público lida com um contrato deste porte, é importante que haja uma distância entre a empresa que vai construir o hospital e os funcionários públicos que vão aprovar tal contrato. No meu ponto de vista, e penso que a maioria das pessoas na Suécia concorda, é essencial que funcionários públicos não aceitem ofertas ou presentes de nenhum tipo, mesmo os de baixo valor.
. Os suecos em geral parecem realmente ter receio da regra que proíbe aceitar qualquer brinde ou presente com valor acima de aproximadamente 400 coroas suecas.
GUNNAR STETLER: Em geral, nenhum funcionário público ou privado na Suécia é autorizado a aceitar brindes ou presentes acima de 300 ou no máximo 400 coroas (entre cerca de 46 e 60 dólares). Na minha posição, não posso aceitar nada.
. Nada?
GUNNAR STETLER: Não. Nem mesmo um café com wienerbröd (tipo de pão doce sueco). E não acho que políticos ou funcionários públicos na Suécia aceitam, em geral, o que é considerado como suborno real, ou seja, grandes subornos.
. Não acontece?
GUNNAR STETLER: Pode acontecer, mas não é normal. A questão é definir o que é considerado como um suborno. Para alguns, aceitar um convite para jantar ou passar o fim de semana em um resort não configura um suborno. Mas na Suécia, convites deste tipo caracterizam de fato um suborno. Principalmente para aqueles que trabalham no setor público.
. Aceitar um convite para jantar pode então ser considerado um crime?
GUNNAR STETLER: Na minha opinião, uma pessoa ou empresa privada não pode convidar um funcionário público para jantar, se há um negócio envolvido entre as duas partes.
. Qual é o seu melhor conselho para um país como o Brasil se tornar uma sociedade mais limpa?
GUNNAR STETLER: É preciso compreender que esta é uma tarefa que não pode ser cumprida em 24 horas. Para combater a corrupção, é necessário implementar um sistema de ampla transparência dos poderes estatais, aumentar o nível de educação da população em geral, e promover a igualdade social. A educação é o princípio básico do que chamamos na Suécia de jämlikheten (a igualdade social). E este é também um fator importante na prevenção da corrupção. Parece-me que o Brasil é um país com enormes desigualdades sociais.
. Qual a importância da igualdade social neste processo?
GUNNAR STETLER: Se uma pessoa tem que lutar diariamente por sua sobrevivência, para ter acesso a alimentação, escolas e hospitais, a questão do combate à corrupção na sociedade certamente não estará entre seus principais interesses. Mas quando uma pessoa se sente parte da sociedade à qual pertence, passa a não aceitar os abusos do poder.
